My Tariff Generator:Terms and Conditions(Version 3.0)The following Terms and Conditions detailed in this and the “Returns” section comprise your agreement with Touch Mobile Ltd T/A mytariffgenerator.com for supply of goods and services by us. We may change these Terms from time to time without notice to you. However, any changes will only apply to any orders received after the change. We aim to ensure that all the terms laid out do comply with the current law, however if any passage is deemed to be unlawful, this will not invalidate the remainder of the contract. All offers are subject to availability and are inclusive of VAT and delivery. We accept Visa, MasterCard, Delta & Switch, for all contract orders the sum of £2.00 will be pre-authorised on your card as part of the identification process. Where payment is required for an item, this will be taken once your order is ready for dispatch. Contract mobile phones are subject to status and a credit check. In some cases, an additional proof of address and or identification may be asked for. The network may require a deposit or decline your application but you will be notified in all cases. All contract mobile phones and SIM cards are subject to a minimum 12 month airtime agreement and unless otherwise stated, are subject to a connection charge. Many of our offers are tariff dependent, where the purchase price reduces as the monthly tariff increases. A tariff upgrade or downgrade is based upon the commission paid to subsidise the cost of the handset at the time of purchase and is not necessarily linked to the monthly line rental. Therefore should you wish to change your tariff, please contact us first to ensure you do not inadvertently downgrade and become subject to the conditions below. Should you decide to downgrade your tariff the following criteria and charges will apply: Orange, Vodafone and Three: If in the first 180 days from connection you downgrade your tariff, you will be charged a minimum of £120 + VAT dependant upon tariff chosen at connection and the new tariff selected. O2: If in the first 120 days from connection you downgrade your tariff you will be charged a minimum of £120 + VAT dependant upon tariff chosen at connection and the new tariff selected. T-mobile: If in the first 12 months from connection you downgrade your tariff, you will be charged a minimum of £120 + VAT dependant upon tariff chosen at connection and the new tariff selected. Should you change your tariff during the first period, either up or down, the "first period" starts again from the date of change. In the event of your disconnection from any network for whatever reason within 180 days (other than 7/14 day returns), we will charge you the full retail cost of the handset, accessories and promotional items plus administrative and any other associated costs incurred. If you PORT or migrate a number after connection, onto either O2 or Vodafone, or if you transfer a number from the same network onto a phone we have supplied on that network, this will be deemed as a disconnection and subject to the same penalties. In the event of either of the above you shall hereby authorise Touch Mobile Ltd T/A mytariffgenerator.com to charge the amounts to the credit/debit card details given as proof of id/purchase. In addition, the occurrence of any of the above will nullify any promotion or giveaway that Touch Mobile Ltd T/A mytariffgenerator.com offer with the purchase of a handset. Whilst we take every care to provide accurate information online, all prices on an order will need to be validated as part of the acceptance procedure. In addition it should be noted that promotions and pricings may change at the beginning of a calendar month. We will inform you if a product’s correct price is higher than stated in your order, or if a promotion is different from that shown online. You will reserve the right to cancel the order and will be offered the choice whether or not to continue with the correct deal as specified. Please note that whilst we attempt to keep all product images on the site as accurate as possible, exact colour can vary between networks and available supply. SIM Free handsets are enabled to operate on the majority of European networks, however Touch Mobile Ltd T/A mytariffgenerator.com do not guarantee that all features advertised will operate on all networks, as some features (such as GPRS & MMS) are network and service dependent. We regret that if a phone proves to be incompatible with some network features, we cannot treat the item as faulty and it will be subject to the normal terms relating to returns. For conditions on returning any equipment please see our returns policy. CashbacksCashback offers can be claimed from month 6 of your contract. Where the amount is less than £50, then this will be paid in one instalment after the receipt of your 6th month’s invoice as per the instructions below. On 12 month contracts, cashbacks valued over £50 will be paid in 3 instalments, one third of the cashback at month 6, one third at month 9 and the final third on month 12. On 18 month contracts, cashbacks valued over £50 will be paid in 5 instalments, one fifth of the cashback at month 6 and the subsequent fifths at months 9, 12, 15 and 18 sequentially. N.B. For clarification the 6th month’s invoice is classed as the first invoice you receive on or after you have had the phone for a period of 180 days from the date of connection. The invoices for month’s 9, 12, 15 and 18 are therefore those you receive 3, 6, 9 & 12 months subsequently. To claim your cashback you will be required to send us your original invoice from your network for the month you are claiming for, which must be received 14 days from the date on the invoice (inclusive), along with a letter requesting the cashback to our address as below: Claims Cashback applications will be processed within 28 days of the date of receipt. Where a Cashback is claimed in instalments, claims for subsequent instalments are dependent on acceptance of the previous claim. Where a cashback is offered as a line rental discount, the value of the cashback is calculated on the original tariff selected. Please note proof of sending is not considered to be proof of receipt. Returns and Cancellations(Version 3.0)Touch Mobile Ltd T/A mytariffgenerator.com understand that occasionally you may wish to cancel an order or return your purchase for an exchange or refund. For clarity we may differentiate between a cancellation and a return. The definitions of which are explained below in the following terms and conditions: Accessories, Electronic goods, SIM free handsets, Prepay SIM´s and handsets:Under the Consumer Protection (Distance Selling) Regulations 2000 (SI 2000 No. 2334), you have the right to cancel the contract for the purchase of your order within 7 working days of delivery (starting the day after the receipt of the goods). For all accessory, electronic goods, SIM card and SIM Free purchases a Return is deemed to be any cancellation request after payment has been taken and the delivery process has begun, or where the item has been despatched. A Cancellation is a request made before this point. All accessories, Electronic goods, SIM free handsets, prepay SIM´s and handsets must be returned to us within the above period. We reserve the right to refuse any goods returned to us outside of this period, with the exception of faulty goods, as outlined in the General Terms below. Please note proof of sending is not considered to be proof of receipt. Contract Handsets & Upgrades:Under the Consumer Protection (Distance Selling) Regulations 2000 (SI 2000 No. 2334), you have the right to cancel the contract for the service and associated goods within 7 working days of the commencement of the contract (starting the day after the date of contract). Where a phone is ordered on a new contract or upgrade, you agree that the date of contract will commence on connection or confirmation of upgrade, which of necessity will be before despatch of the item to you. This will mean that your statutory right to cancel will not apply, so Touch Mobile Ltd T/A mytariffgenerator.com offer the returns periods outlined in this section. For all contract handsets a Return is deemed to be any cancellation after the network have confirmed a connection request. A Cancellation is a request made before this point. Please note that we may not take payment for an order until a connection request has been confirmed, if payment cannot subsequently be taken and a customer wishes to cancel, the request will still be treated as a return. For a Contract Upgrade, a Return is deemed to be any cancellation request after the network have confirmed the upgrade request. A Cancellation is a request made before this point. Please note that we may not take payment for an order until an upgrade request has been confirmed, if payment cannot subsequently be taken and a customer wishes to cancel, the request will still be treated as a return. For all contract returns, we will require the goods to be returned to us in an ‘acceptable condition’ as described in the General Terms below, before we can terminate the contract. In addition to notice of cancellation, the goods supplied with the service must be returned to us within the time frames set below. Please note proof of sending is not considered to be proof of receipt: O2, Orange, Vodafone and 3; you have 14 days from connection to return your handset and SIM card to us for cancellation of contract. Where this returns period ends on a day where we are not open (business hours are posted on our site at all times), it is the customer’s responsibility to ensure that the item being returned arrives on a working day before the returns period expires. T-mobile; you have your 7 working days from date of contract to return your handset and SIM card to us for cancellation of contract. Contract Upgrades; you have 7 working days from date of contract to return your handset and SIM card to us for cancellation of the upgrade. Where a return is requested for non faulty goods an administration charge will apply. Once goods are received back, they will be checked and if acceptable for return the admin fee will be taken. We cannot complete a return until this charge has been taken and cannot accept responsibility for further charges thus incurred. We reserve the right to refuse acceptance of any contract & upgrade handsets received outside of these periods, with the exception of faulty goods, as outlined in the General Terms below. If the above terms are not met, we will be unable to cancel any airtime agreement and you will remain liable under this. Faulty Goods:On the Orange, T-mobile and Three networks, any goods found to be defective within 28 days can be returned to us for inspection. If confirmed to be faulty, the item will be replaced. For accessories, Electronic goods, SIM Free phones and phones sold on O2 and Vodafone, any goods found to be defective within 14 days can be returned to us for inspection. If confirmed to be faulty, the item will be replaced. Goods found to be user damaged or tampered with will not be replaced and will be returned to the customer at their expense. If Touch Mobile Ltd T/A mytariffgenerator.com choose to replace an item, which is subsequently found by the supplier/manufacturer to be not faulty or user damaged, you shall hereby authorise Touch Mobile Ltd T/A mytariffgenerator.com to take the full retail cost of the returned item from the credit/debit card details given as proof of id/purchase. Any item returned as faulty after the above periods will be dealt with in the most appropriate and prompt manner possible through the relevant manufacturer’s service centre. Outside of the faulty return period, returned items can not be accepted, unless covered by manufacturer’s warranty. Items returned to us will be forwarded to the manufacturer for repair or replacement. Please note that warranty claims beyond the initial returns period are resolved in the most prompt manner through your local repair centre. Please call us for manufacturer repair centre details. The above conditions are in addition to your statutory rights, which are not affected. General Terms:In all cases returns should first be authorised by calling us on 01792 879556, weekdays between 8:30am and 4:30pm. If a return is authorised you will be issued with a returns authorisation number, which must be written in the return address as shown below: Returns - <returns number> Any parcels received back without a valid returns number will be rejected. We cannot take responsibility if this subsequently takes you outside of your returns period. If you wish to return the goods, it is your responsibility to ensure that the goods are returned in an ‘acceptable condition’. Touch Mobile Ltd T/A mytariffgenerator.com define an ‘acceptable condition’ as follows: the item must be unused, in good clean condition, in it’s original packaging complete with all components, accessories, manuals and promotional items, and with any software provided still sealed. Goods must be returned to us within the returns periods specified above. If these conditions are not met, we reserve the right to refuse accept the returned goods and we may return the items to you at your cost, at the standard site delivery rates appropriate to the goods being sent. When goods are accepted for return we will refund the total amount of money paid by you for the goods, less any costs to collect and deliver the goods within 28 days of receipt of the goods. Refunds by credit/debit card are made to the same credit/debit card that was used for the original purchase. If you receive any item from us that has been marked or damaged in anyway, or if any items are missing from the parcel, we must be notified within 24 hours of receipt.
